{"id":300,"date":"2019-01-27T22:47:50","date_gmt":"2019-01-27T22:47:50","guid":{"rendered":"http:\/\/equalitiessensitivityrating.com\/?page_id=300"},"modified":"2019-01-27T22:47:50","modified_gmt":"2019-01-27T22:47:50","slug":"equalities-act-2010-is-not-breathing","status":"publish","type":"page","link":"http:\/\/equalitiessensitivityrating.com\/?page_id=300","title":{"rendered":"Equalities Act 2010 \u2018&#8230;Is Not Breathing&#8230;\u2019"},"content":{"rendered":"\n<p>Background: ESR has sampled <strong>Social media \u2013 viral trail<\/strong> on \u2018protected characteristics\u2019 as laid out in Equalities Act 2010.\u00a0 We collated some 41 reports and discussions, and after some rudimentary scorings, have taken a view that Equalities Act 2010 \u2018Is Not Breathing\u2019 i.e. under suffocation.\u00a0 To share this concern, we were persuaded to invoke one article that headed <\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"alignleft\"><img loading=\"lazy\" decoding=\"async\" width=\"139\" height=\"164\" src=\"http:\/\/equalitiessensitivityrating.com\/wp-content\/uploads\/2019\/01\/image-4.png\" alt=\"\" class=\"wp-image-302\"\/><\/figure><\/div>\n\n\n\n<p><em>\u2018&#8230;<a href=\"http:\/\/www.libdemvoice.org\/lord-avebury-was-a-giant-in-the-struggle-to-outlaw-castebased-discrimination-in-the-uk-49444.html\">Lord Avebury was a giant in the struggle to outlaw Caste-based discrimination in the UK<\/a>&#8230;\u2019<\/em>\u00a0 The aim here is to account on the state of Equalities Act 2010, in the name of, and to Lord Avebury, who passed away in Feb 2016.\u00a0 His quoted comment about the end of his BREATHING<em> \u201c&#8230;may be I should leave my body to the Battersea Dogs Home&#8230;\u201d<\/em>, made us go further to posit, that this statement may have been a result of suffocation by all sorts of discriminations dovetailing into Equalities Act 2010, through his efforts.\u00a0 If we may add, he may have so felt that the dogs would possibly benefit better, an indictment to progress made to stem all sorts of discrimination.\u00a0 ESRL\u2019s last word on this is:<\/p>\n\n\n\n<p><em>\u2018&#8230;Farewell thee, Lord Avebury, to ESRL, you have walked in the footprints of William Wilberforce, Mahtama Ghandi, Martin Luther King, Nelson Mandela&#8230;\u2019<\/em><\/p>\n\n\n\n<p>The Score: After some sieving of the viral trail using\na SWOT analysis, ESRL is anxious that\nEqualities Act 2010 <em>\u2018&#8230;Is NOT Breathing&#8230;\u2019<\/em>, hence the following summary:<\/p>\n\n\n\n<p>Strength: = 6 (15%) topics out of 41:\nThe narratives on these were laced with soft describing words, and had to dig\nfour levels deep to find them.&nbsp; <\/em><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;need\nto redesign rules for social engagements; <\/em><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;there\nshould be penalties and liabilities attached to discriminations&#8230;\u2019;<\/em><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;treated\nless favourably &#8230;\u2019 to repackage as into three components i.e. Direct,\nIndirect and Remote\u2019;<\/em><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;Stand-up\nagainst all sorts of discrimination&#8230;\u2019<\/em><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;Good\npractice in policy making and policy implementing levels sensitive to protected\ncharacteristics&#8230;\u2019<\/em><\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;Long\nlive Lord Avebury&#8230;\u2019<\/em><\/p><\/blockquote>\n\n\n\n<p>Weakness: = 8 (19%) topics out of\n41: The narratives on these were laced with fear-expressing phrases, and only\nhad to dig one level deep to expose their fangs.&nbsp; Here are the select of gate-keeping\ndescriptions ala fierce dogs, keeping \u2018Strengths\u2019 and \u2018Opportunities\u2019 at\nbay or buried.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;Law\nsuit is to establish what the Law says&#8230;if you lose&#8230;!! &#8230; another Law suit\nfollows&#8230;\u2019 \u2013<\/em> suggesting necessary financial muscle.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230; \u2018Protected\ncharacteristics\u2019 is about phobia and ignorance &#8230;\u2019<\/em>\nsuggesting blaming mental health impairment.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;Protest\nto retain legal protection, otherwise it will be reversed&#8230;.\u2019<\/em> \u2013\nsuggesting too many loopholes.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;why\ndiscriminate me and not the others&#8230;\u2019<\/em> suggesting a contest to\ngain advantage. <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;is\n\u2018Protected Characteristics\u2019 about \u2018Scrutiny\u2019 or \u2018Enforcement\u2019&#8230;\u2019<\/em>\nsuggesting seeking to fix the agenda i.e. a particular agenda; a neutral\nagenda; a harmonising agenda; etc.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;no\nground to address concerns&#8230;\u2019<\/em> suggesting strengthen the\ncase for \u2018Protected Characteristics\u2019.<\/p><\/blockquote>\n\n\n\n<p>Opportunities = 7\n(17%) topics out of 41: The narratives on these were laced with soothing\nphrases and had to dig two levels deep to find them.&nbsp; Here are the select of soothing words and\nphrases: <\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;A\nprotected person is not only natural&#8230;\u2019<\/em> suggesting body corporate,\nhidden loopholes, etc.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;standardise\nrules of investigating discrimination&#8230;\u2019<\/em> suggesting links to\nresources allocation, redesign social engagements, redesign penalties and\nliabilities.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;make\neconomic sense&#8230;\u2019<\/em> suggesting involving financial wizards on\npotential to make money i.e. deepen the skills reach, widen schools of thought;\nbuy in branding as a product.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;should\ninclude familial status&#8230;\u2019<\/em> suggesting close legal loopholes\non vulnerabilities in other duties or commitments; captures of hidden\ndiscriminations. Etc.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;Check\nout footprints on protected characteristics&#8230;\u2019<\/em>\nsuggesting it is not walking alone or not a lonely walk.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&nbsp;&nbsp; Data analytics &#8230;\u2019<\/em>\nsuggesting keeping an eye on technology i.e. to delegate it the function of offering\nburden of proof.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;dynamic\nliving&#8230;<\/em>\u2019 suggesting keep up with change of circumstances or\nreasonable adjustments for both employer and employed.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;benchmarking\n&#8230;\u2019<\/em>\nsuggesting cross-cultural standards using PESTILE tool in the analysis.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230; The narratives were laced with\nmenacing hard hitting wordings, weighted by the number 20 oppressing or\nsuppressing all the above.&nbsp; Here are the\nselect of words and phrases met while digging:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;\u2018person\u2019\nis not clear&#8230;\u2019 <\/em>towards body corporate at centre and not\nnatural person i.e. commodify the word so that money can be made.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;review\ncensus questions&#8230;\u2019<\/em> towards privacy protected and there is a\npotential for public rejection on identifying \u2018protected characteristics\u2019.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;referendum\non values to overturn inadequate laws&#8230;\u2019<\/em> towards the championing of\nvalues, and not discrimination.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;blame\nthe law for repressive laws repressive&#8230;\u2019<\/em> towards sell date expired\nstamp on \u2018protected characteristics\u2019.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;should\nbe a hate crime&#8230;\u2019<\/em> towards to remove involving the law to\nestablish discrimination but public opinion to address wayward behaviours.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u2018&#8230;end non-legal engagement excluded&#8230;\u2019 towards\nunpaid engagements i.e. social, cultural, political, activities excluded. <\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;incentify\nthe organised groups involved in lobbying&#8230;\u2019<\/em> towards power play of the\nweak versus the strong; create a distance between those nearest or accessible\nto resources allocation to be strengthened and those furthest to be weakened.<\/p><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p><em>\u2018&#8230;opinions\non discrimination practices are misguided&#8230;\u2019<\/em> towards the downgrading of\nvocabularies such as \u2018representative of community\u2019;
